Aventura is in northeast Miami-Dade County, a short trip south of our Hollywood office. If you were hurt in Aventura, Alexandra Linder Diaz can help you understand your claim, with a free consultation and no fee unless we win.
Aventura is compact, but it is busy. Shoppers, residents of its high-rise communities, workers and visitors all move through a small area packed with traffic lights, parking garages and crosswalks. Crashes, falls and other injuries happen here every week.
Linder Diaz Law is based in downtown Hollywood, in Broward County, and we serve clients in Aventura and across northern Miami-Dade. Your first consultation is free. We work on contingency, so there are no upfront costs and no fee unless we win. Call or text (305) 853-8628 any time.
Most Aventura traffic funnels onto a handful of roads. These are some of the places where injuries often happen:
Stop-and-go traffic on Biscayne Boulevard leads to many rear-end collisions. Pedestrians crossing busy intersections, and people walking to and from the city’s free on-demand shuttle, are also at risk when a driver isn’t paying attention.
Crashes inside Aventura are generally handled by the Aventura Police Department, which is located at the city’s Government Center, 19200 West Country Club Drive. If a crash happened on I-95 or outside city limits, another agency may have written the report, so check the agency name on your paperwork.
Aventura Police use a sworn statement form for crash report requests, based on Florida law. Within the first 60 days, reports are released only to eligible people, such as those involved in the crash, their legal representatives and licensed insurance agents. After 60 days, a different sworn certification applies. You can reach the records section through the city’s police records line.
Crash reports can also be purchased from the state through the Florida Crash Portal. If you hire us, we request the report and handle the paperwork.
Even though our office is in Broward, an injury that happens in Aventura falls under Miami-Dade County’s courts, which make up Florida’s 11th Judicial Circuit. If a lawsuit is necessary, it would generally be filed in Miami-Dade, not Broward.
The Miami-Dade Clerk of the Court operates the North Dade Justice Center at 15555 Biscayne Boulevard, a short drive from Aventura. It handles county court civil matters, including small claims, as well as traffic and other services. Larger injury claims are typically circuit court cases filed with the Miami-Dade Clerk, and we will explain where and how your case would proceed.
The core Florida rules are the same on both sides of the county line: the two-year deadline for most negligence claims arising on or after March 24, 2023, PIP, and modified comparative negligence, which bars recovery if you are more than 50% at fault.
With so much shopping, dining and residential living in one place, Aventura sees a mix of claims:
For a fall caused by a spill or other substance in a business, Florida law requires you to show the business knew, or should have known, about the hazard and should have fixed it. Evidence like photos, incident reports and witness names, gathered quickly, can be important.
In vehicle crashes, keep in mind that bodily injury liability coverage is not mandatory for most Florida drivers, so the at-fault driver may carry little or none. Your own UM coverage can fill that gap. Our guide to uninsured motorist coverage in Florida explains how.
For example (hypothetical): a retired teacher is walking through a shopping center on Biscayne Boulevard when she slips on spilled liquid near a food court. She breaks her hip. Her daughter takes photos of the puddle, which has cart tracks running through it, and gets the name of a worker who says the spill had been there a while.
Those details may help show the business had constructive knowledge of the hazard, which Florida law requires. A lawyer would ask the property owner to preserve security footage, collect her medical records and evaluate her claim under Miami-Dade’s courts if a fair settlement isn’t offered. Every case depends on its own facts.
Our only office is at 1909 Tyler Street, Suite 503, in downtown Hollywood. From Aventura, many clients head north on Biscayne Boulevard, which continues into Broward as Federal Highway (U.S. 1), or take I-95 north, then go to Hollywood Boulevard. Details are on our Hollywood office page.
You don’t need to make the trip to get started. We can meet by phone or video, or come to you if you are recovering. Office appointments are available, including weekends.
