What if I was partially at fault for the accident?
Florida follows a modified comparative negligence rule. If you are 50% or less at fault, you can still recover damages — but your compensation is reduced by your percentage of fault. If you are found to be more than 50% at fault, you cannot recover anything. For example, if your damages are $100,000 and you are 20% at fault, you would receive $80,000. We work to minimize the fault assigned to you and maximize your recovery.
Do I need a lawyer if the insurance company offered me a settlement?
Almost always, yes. Insurance companies make initial offers that are often well below what a case is actually worth. They count on accident victims accepting quick money without understanding the full value of their claim. A lawyer can evaluate your medical records, calculate future treatment costs, and negotiate for a fair settlement. We review settlement offers for free — you have nothing to lose by having us look before you sign.
What compensation can I receive for my injury?
You may be entitled to several types of compensation: medical expenses (past and future), lost wages and lost earning capacity, property damage, pain and suffering, emotional distress, and in some cases, punitive damages. The specific compensation depends on your injuries, the impact on your life, and the circumstances of the accident. We calculate the full value of your claim — not just today's bills, but the costs you will face in the future.
How long do I have to file a personal injury claim in Florida?
Florida's statute of limitations for personal injury claims is 2 years from the date of the accident. Property damage claims can have a different deadline, so don't assume you have more than 2 years. If you miss the deadline, you lose your right to recover compensation entirely. There are limited exceptions, but they are rare. Do not wait — evidence fades, witnesses move, and memories get less reliable over time.
What should I do immediately after an accident in Hollywood?
First, get medical attention even if you feel fine — some injuries appear days later. Call the police and file a report. Take photos of the scene, vehicle damage, and any visible injuries. Get contact information from witnesses. Do not admit fault or discuss the accident with the other driver's insurance. Report the accident to your own insurance company, but do not give a recorded statement without legal advice. Then call us at (305) 853-8628 for a free consultation.
How much does an injury lawyer cost in Florida?
We work on a contingency fee basis. That means you pay nothing upfront and nothing out of pocket. We only get paid if we win your case — our fee is a percentage of the settlement or verdict we recover for you. If we do not recover compensation, you owe us nothing. This arrangement lets everyone access quality legal representation regardless of their financial situation. Your initial consultation is also free.
